Can I win the appeal?
Questioner
I recently received a traffic ticket for offence code R618A, using a point piece as a driver. The officer told me that I took the exit too late, after which I would receive a ticket at home. When the traffic ticket notice arrived at home, it said that I had used a white point piece. However, I took the ''second'' exit, and did not come close to the point piece.Lawyer
It is almost always wise to file an appeal in order to gain access to the file in this way. This should include a report from the reporting officer. This way you can see if any mistakes were made and/or if the applicable procedures were followed. Only then can it actually be assessed whether the appeal is worthwhile. You can file a pro forma appeal and request a copy of the file and an additional period to supplement the grounds for the appeal. A lawyer can often help on a 'no cure, no pay' basis. If the appeal is won, the government usually has to reimburse a standard amount for the legal costs.
