Why still collect debts now?

Questioner

I have a question. I was under guardianship from 2012 to November 30, 2021. I also went through a debt process from October 31, 2018 to October 31, 2021, so I was declared debt-free. I had barely paid for everything when I received a letter from the collection agency Intrum. They had not responded for all those years and then suddenly they came up with an outstanding invoice of 138 euros from 2010. And a week later a letter from Alektum without a date of when the invoice was received, but it must have been before I went under administration. I had also not heard anything in all those years and had barely gotten out of debt and then suddenly 2 letters arrived in the mailbox. Do they still have the right to claim those notes? I find this very strange. With kind regards, Christianna

If you have been given a clean slate, this also applies to creditors who were not aware of your debt relief process. They could have seen these in the insolvency register. You could also ask your (former) administrator whether these claims were known. In addition, claims can also expire. The limitation period depends on the type of claim. But a claim from 2010 sounds very long ago at first glance. It is important to respond to the collection agency anyway. You can explain the situation and indicate (if you have been given a clean slate) that you assume that the claims are no longer collectible.
