Employer wants me to take early retirement

Questioner

My husband has been on sick leave for 6 months now, due to a diagnosis we have to apply for an IVA benefit. Employer wants my husband to take early retirement. We need your help and advice to handle this further. They have made another proposal and we cannot agree with it. We feel pressured from their side. We would like to see if you can assist us. Thank you in advance

Lawyer

It is important to carefully consider your rights in these types of matters. In most cases, the first year entitlement is 70 to 100% of the salary. The second year it is 70%. Usually the employer is insured for such cases. The employer must pay these costs for the first two years. If there is still illness, you will end up in the WIA or IVA. It is therefore not always beneficial to retire early, for example. No more pension will be built up and in this way there will be less pension left. Your husband cannot be forced to retire early. What kind of contract does your husband have? Please feel free to contact me via my profile if you have any questions or require legal assistance.
