What rules apply to purchasing and selling around web shops?
Questioner
For my webshop I want to buy crochet yarn and stuffing wool from a random webshop, and then resell it in the form of a crochet kit (with added crochet pattern of my own design) via my own webshop. - Am I legally allowed to do this? - Can I do this without consulting the contact person from whom I purchased the items? - Can I determine the price myself? Yours sincerely,Lawyer
In principle, products may be resold once they have been legally marketed (this may sometimes be different for products from outside Europe). You may determine the prices yourself. For specific products, rules may apply (alcohol, for example). Also, for branded products, there may be a violation of copyright/trademark law if, for example, you place photos where the logo is visible. You indicate that it concerns random crochet yarn and filling wool that you buy yourself. You could therefore even 'simply' resell these products, you add something. In principle, it is therefore not necessary to discuss this. Read more about this topic (from the consumer's perspective) in the article below. https://bit.ly/3HG3EZJ There are many rules within the European Union that you must comply with regarding informing consumers about their rights (e.g. the right of withdrawal). You can contact me without obligation via my profile if you have any (other) questions.Questioner
Dear Dennis, Thank you for your answer. It is about crochet yarn of a certain brand (Rio Lammy Yarns) and the filling wool is of the brand Restyle. Is that still a problem? These products are available everywhere online. Kind regards, Eveline van der VeenLawyer
Don't mention it. That shouldn't be a problem. If these products were purchased legally, you may resell them. Example: It often happens that, for example, the supplier of new brand shoes has an agreement with a number of shops. Only those shops are allowed to sell the products 'new'. As soon as someone has bought them there, that person is allowed to resell them (possibly after modification). If you want to play it really safe you could make sure the brand name is not visible on any photos of your packages/products, remove the wrapper, use your own wrapper/bow.Neem de volgende stap
