Personal Records Database (BRP), discussion with municipality
Questioner
I sold my house in Apeldoorn in 2020 and registered us with my sister in Tiel. I still have a house in France, but after a thorough renovation I only want to be there in the summer months. I am a pre-pensioner and want to travel through Europe with a camper for the rest of the year and then we have no fixed address. The municipality of Tiel now wants us, although they explained it differently at the time, to deregister from the municipality within 14 days. But I am in Apeldoorn and Tiel for a few days every month, because of family, friends and sometimes freelance jobs. We have to fill out an emigration form and state an address abroad on it. An address that we will not have, except for the summer months. That is not practical. I have been in contact with the Tax and Customs Administration, SVB and RDW. For these agencies it is important that I have a correspondence address in the Netherlands. For me too, because I continue to pay taxes in the Netherlands. But I honestly have little confidence that everything will turn out well. And so I have to arrange many things. The correspondence with the municipality: As we discussed last Monday, you cannot remain registered at your address in Tiel. This also applies to Mrs. XX. You indicate that you are in Tiel 1 to 2 times a month. In order to be registered, you must reside at this address for at least 2/3 of a half year, i.e. live, sleep and receive visitors. You do not meet this requirement. It is therefore important that you both complete the emigration form, sign it and email it back to us. You still have 2 weeks to do this. After that, we will officially deregister you abroad.' Thank you for your answer. In our first conversation you said that I can convert my current address into a correspondence address. I would like to use this option because I will continue to pay taxes in the Netherlands and therefore need/want to be reachable for the tax authorities. I would like to hear from you how I can arrange this correspondence address. Dear Mr. XXX, I told you that you must deregister in France and that you can provide a correspondence address to the relevant authorities You can deregister abroad using the emigration forms attached in the previous email. Greetings, I have been in contact with various RNI municipalities in response to this. There is no uniform policy in this area. Even a city like Maastricht has no problem with you being registered with family and only being in the Netherlands occasionally. Any consequences of unsubscribing can be solved, but cost time and energy. I am considering buying something in NL again for that reason, but that will not be realized within a month. What do you suggest I can do?Lawyer
The problem is that you state that you have been staying in the Netherlands for less than 4 months, whether or not affiliated, and that fact means that municipalities apply the law that applies to everyone: then you are not considered to live in the Netherlands and the Netherlands is not your permanent country of residence. You can register with family, for example by renting a room there, but you must meet the 4-month requirement. If you are with a camper, you may also register at a permanent camping address abroad, but you will have to insure yourself for care because that right expires if you do not have your permanent home address in the Netherlands. Private expat health insurance is expensive if you are a bit older (400 or more pm)Lawyer
I read that you do work in the Netherlands, does that also apply to your partner? If you work in the Netherlands you are obliged to have health insurance, but in the case of emigration this does not apply directly to the partner.Neem de volgende stap
