Right to a refund of course fees?
Questioner
I am following a coaching trajectory/training for entrepreneurs, but have been dissatisfied with the quality of the training since day 1. Unstructured, chaotic, fast talking, not always taking questions seriously and lack of clarity were part of my dissatisfaction. In addition, even fellow students noticed that he asked my opinion quite often, without responding to the homework of my fellow students in terms of content. I requested a meeting with the trainer about this after the 4th. When I mentioned my problem with the training, the training immediately pointed to a fellow student. She was supposedly the reason for all the unrest; 'autistic, severe ADHD and she negatively influences the days. If she would pay, it would not be a problem! But I have already sent a reminder, I should actually remove her from the training (...)' Anyway, she was the whole problem. I immediately indicated that this is exactly the behavior that I have a problem with! He apologized for this, and then immediately went on about her not paying. Later he spoke about another fellow student who is coaching him about his nutrition. 'I coach her more than she coaches me. And the advice; no coffee in the morning! Nonsense, that's water with a flavour.' Again, an attitude and a way of speaking that is not very nuanced and does not testify to respect and confidentiality. My 'problem' with the trainer did not decrease after this conversation, but rather increased. I no longer trust him as a coach. In addition, his attitude is extremely overwhelming. It was not until the weekend after this conversation (it took place on Friday) that I really realized what he had said. Without any hesitation, he immediately pointed to a fellow student as the culprit for my problem with his quality! Not only did he not take responsibility, but he also caused a loyalty dilemma for me. I still have to work with this lady(s) throughout the entire process, knowing how he really looks at them! And what does that say about his view of me? I sent an email on Monday in which I stated that I really resent him for letting confidentiality slide so easily and that I would like to stop the training. In his response he said that it is because of my 'resistance to commerce', according to him that is not a problem, I just have to get over it and that he makes a success of my company. After this reaction my feeling has not improved! Especially not now that he dares to blame the lack of quality and overview in his training on something else, in this case my 'Aversion to Commerce'! I let him know and suggested to stop the training, to get the remaining days of lessons refunded and the promise that we will keep this situation between us. I sent this response last Thursday morning at 05:00, because unfortunately I am kept awake by this situation. I have been removed from the app group by him and have not received any response to date. My question to you, how realistic is it to claim the remaining amount back and how strong am I legally. Thank you very much for your response! Kind regards,Lawyer
You must first put the course provider in default with a date in the past and also say that he had the opportunity to resolve the defects that he confirmed, which did not happen, which caused default. Then you claim back all course fees. The question is of course how seriously your letter is taken and then whether you will get a refund.
