Termination of purchase agreement

Questioner

I bought 2 identical sofas last year (in 1 purchase agreement). Delivery time would be max 16 weeks. After 16 weeks the first sofa was ready. Called about delivery of second sofa, no response. Received an email stating that the second sofa would arrive in a few weeks. Contacting them to ask what that meant (a few weeks) was not possible, and there was no response by email or telephone. Indicated that they would have 4 weeks from me to arrange the entire delivery. No response. After 20 weeks, we cancelled the purchase by email and registered letter. Including the statement that the deposit had to be refunded, in accordance with the delivery conditions recognized by CBW. No response received. Telephone contact was not possible, many call back requests left. Finally able to speak to a manager about refund of the deposit, This was promised by telephone. After a week I received an email that I did not receive this and that I also had to pay cancellation costs, the same amount as the deposit. (more than 2800 euros). What else can I do? regards

Under consumer law (but even if that were not the case) an agreement may be terminated if the agreements are not met. Usually the seller must be given an additional term. In this case, the agreement has not been fulfilled. You have requested information and granted the seller an additional period. That seems to be sufficient to terminate the agreement. The seller cannot charge you cancellation fees. In addition, you have received a commitment over the phone. It is important to make this clear to the seller and you can give a term to proceed with payment. The seller must be able to demonstrate that he has complied with the consumer rights and that you were not allowed to terminate the agreement (you can demonstrate that you do not have the bank and have given an additional term).
