What happens to the right to have a garage?
Questioner
We bought our house in 2000. There are 2 garages on our property, 1 of which is used by our neighbours. (neighbors probably built the semi-detached garage together at the time, but largely on our property) in the proof of ownership it is stated as follows: Buyer grants to (Mr. ...... and his family) the personal right to have a garage on the property sold, as well as the personal right to come and go with a car, (moped) bicycle or other small vehicle or on foot to and from the .. street to and from the garage, all in the manner currently existing. The aforementioned rights will lapse upon demolition of the garage. the house has since been sold to the daughter of the neighbors, and they lived in the house until their death, together with their daughter However, he has now passed away. the house is now going to be sold outside the family. what will change in the situation now? right of way will expire if all goes well, but what about the right: having a garage on a large part of our plot? will this also expire now? We have always had nice neighbors, and also good contact with children & grandchildren. But are now curious about what our rights / obligations are exactly, before the house is sold with garage and way and we get into trouble with the new residents about it.Lawyer
The question is whether the daughter also had a personal right despite the fact that she is an heir because of the other capacity, not as a family member anymore. What is now happening after the sale is that there is no real right to your land and garage, but only a personal right ending with death or moving (then usufruct, otherwise by termination of the user agreement.)Lawyer
You might consider presenting the proof of ownership to me and then we could decide whether it is necessary to cancel the personal right of usufruct or use, or to give notice of the termination of the agreement. This will strengthen your position later in the sold status and the document can be inserted in the new deed of sale and the fact can be registered in the Land Registry.Questioner
