New PVC floor breaks
Questioner
In a nutshell: I purchased a PVC floor. This one hasn't even been lying around for a year and is already broken. Seams are coming loose and parts are warping. I would like to, based on the text in their advertisement and the way in which I was informed on site claim the warranty but they refuse. After sending photos they do want to come and have a look but because it is too far to drive they call in a local specialist. This turns out to be a subcontractor and therefore not independent. The specialist judges in my favor on the spot but the supplier himself says the opposite. I get vague questions and comments that are contradicted on their site and my photos suddenly seem irrelevant. I think I am completely within my rights but how do I get this now? I have no financial means anymore.Lawyer
What an annoying situation. The specialist hired by the company will judge in your favor and the company will do nothing about it. If a product is not good, you are entitled to repair, replacement or your money back. In some cases, additional compensation will also have to be paid for replacing the product (for example, the installation costs of a new floor). A lawyer or attorney can usually help you in such cases. Often a letter from a lawyer or attorney also has a deterrent effect and a company is then suddenly able to negotiate. A lawyer may also work (partly) on a 'no cure, no pay' basis. This means that you only have to pay (part of) the costs if a positive result is achieved. This can be interesting in these types of cases. Please feel free to contact me if you would like to discuss whether I can help you.Questioner
Dear Mr. Uygul - van Dam, Thank you very much for your response, I have a few questions but need to clarify something clarify. The local inspector (subcontractor of the supplier) told me that he had an advice would give that would be to my advantage. I hear from the supplier that the inspector has a complete other report has made just to my disadvantage. The supplier then has a small discount offered if I would buy a new floor from them. My questions: I read about your no cure no pay policy. What does that mean for me step by step? I live on a subsistence level and therefore unfortunately have to know exactly what I am getting into. Do you need further information? I can send you the mail exchanges, pictures and the specifications of the product. I look forward to hearing from you. Yours sincerely, Mark BaanLawyer
Thanks for the additional information. I think it is important to find out what was reported by the local inspector. Could you email me at mail@uygulvandam.nl? Based on your information, I can make a free assessment of the case. Based on that, I can indicate under which conditions I could assist you. Usually, it comes down to a certain amount being agreed for a number of basic activities and the rest only having to be paid in the event of a positive result. In addition, those costs can often be recovered from the other party. I will of course send you a proposal clearly, concretely and in writing. I will never charge any fees without your approval.Neem de volgende stap
