When is the landlord liable?

Questioner

Since the end of October we have been renting an apartment privately. We soon discovered that there are mice, both in our house and with other residents. After trying several things myself (storing all food in closed containers, poison, electronic mouse repellents), the problem is still not solved and the mice are becoming more and more brazen. Now my question: For a next step, such as pest control and/or closing small holes and cracks. Are we as tenants liable for the costs, or are the landlords?

Minor maintenance and minor repairs can generally be expected of the tenant. The legislator has indicated in the 'decree on minor repairs' which points are in any case for the tenant. https://wetten.overheid.nl/BWBR0014931/2003-08-01 Under R it says the following: 'r. the control of vermin, provided that no significant costs are involved and provided that the presence of such vermin is not a consequence of the structural situation of the living space;' Depending on the exact circumstances of the case, the landlord is probably responsible for the problem in this case. You can ask the landlord to (jointly) address the problem. If you hire someone yourself, they will probably bill you. Please feel free to contact me if you have any questions or require assistance.
