Can I claim back money from an extremely high electrician's bill?
Questioner
On 31/12/2021 an electrician carried out work in my elderly parents' house. He charged €2892.40 for this, which had to be paid immediately by debit card. The work carried out is not in proportion to this amount. The engineer replaced 2 circuit breakers (these are the 'group switches') in the meter cupboard. The used circuit breakers can be purchased online elsewhere for €25 to €35. On the engineer's invoice they are listed for €345 and €450. The rest of the invoice is 'work', 'hourly wage', 'holiday storage', etc. My parents are 82 years old. My father is no longer legally competent and my mother is not good with money. They were overwhelmed by this electrician and paid the bill without protest, unfortunately. I already called the electrician and he told me that the invoice was correct. When I asked if the machines were made of gold, he said 'yes, that could be possible'.... Now my question to you is: is there a legal possibility to reclaim part of the money paid?Lawyer
Normally, paying an invoice without protest means that the debt has been settled and it is difficult to go back on it. However, you have a clear story and it is also known that unfortunately there are many companies active in this sector that charge far too high amounts. Perhaps there are already more reports about this company. In addition, your parents are elderly. Depending on the exact circumstances of the case, there could be abuse of circumstances (Article 3:44 paragraph 4 BW). In that case, the legal act would be voidable. It is wise to investigate this thoroughly/put it on paper or discuss it with a lawyer, for example.
