Former employer withholds part of last salary

Questioner

I have resigned from my last employer. There was a bicycle plan that I made use of. A contract was drawn up for this in which it is stated that over three years, €500 will be deducted per calendar year. During my last settlement I clearly asked how this would be handled and this was also clearly answered and this was confirmed by email. Nl; contract was entered into as of September 2020. exit is as of December 2021. That is why we see 2 calendar years as having passed. €1000 is lost and there is still €500 outstanding. We will deduct this from your last salary. Now I get my last salary transferred and together with my payslip I see that he apparently changed his mind and now deducts an extra €375,-. This while it is stated differently in the contract and in the email. Is this possible?

Lawyer

No, not if you have agreed otherwise. You could start by asking your ex-employer for an explanation. What does the EUR 375 refer to? Perhaps it refers to something else?

Questioner

I can see in my pay slip that he deducts that for the bicycle scheme. That is clear.

Questioner

as it seems to me he is now scrapping the calendar year regulation and will deduct per month. given that the regulation went into effect in september 2020 he is therefore deducting 3/4 of that calendar year.
