Who is responsible within the VVE in the event of a leak?

In a small VVE (4 apartments for sale) there is a leak in one of the apartments. The cause seems logically to be in the sanitary facilities of the apartment above, since both are directly above the various leak spots. Two questions: - Who should conduct the investigation in the first place? - Who is responsible for the solution, if after investigation it appears that the cause lies in construction errors? Perhaps interesting that similar problems have also occurred in other apartments (cause construction error), in those cases the apartment owners themselves have covered the costs.
