Objection to environmental permit objector

Questioner

Is there a possibility to do something, to recover from/at someone who objected to an environmental permit for a new construction project with such clumsy statements that it was clear in advance that the objections would be declared unfounded. Which is what happened. This 'right' delayed the start, which meant I had to extend my mortgage offer and this cost me a considerable fine. Is it possible for me to recover these costs? I have searched for an answer but can't find anything, so I assume it is not possible. But I would like to hear this from an expert. Thank you for your response.

Lawyer

You indicate that you have suffered damage due to the actions of the person who objected. Making an objection is a right that stakeholders have in a decision. Since this is a legal right, it will not be abused quickly. Questions that may be important: -the person knew that there was no way to file an objection, -that damage would occur to you and -this person nevertheless consciously objected. In the event that this person has acted unlawfully and you have suffered damage as a result, you can try to hold someone liable on the grounds of 'unlawful act' (Article 6:162 BW). The chances of success depend on the circumstances of the case. Please feel free to contact me if you require legal assistance.
