Why is car insurance not paying out?
Questioner
My 20 year old son caused a car accident in my car. He did not give way to a driver on the right and also drove faster than the legal speed. My son and the other driver exchanged information and went home (it was 2:30 at night) the next day the police were at the other driver's doorstep. The police indicated that the collision had also caused damage to a house. The collision caused the other car to spin and hit a house. Neither the driver nor my son noticed this on the night of the collision. I reported the damage to my insurer, and they rejected my claim. The reason for this is that there was no police presence that night. The insurance company's reasoning is: my son allegedly violated his duty to cooperate. The damage to the other car and the house will be paid by the insurer and then recovered from my son. Can I object to this reasoning?Lawyer
In such cases it is always wise not to simply agree with a certain point of view. Especially in cases where it is not yet known how big the damage is, or how high the amount will be. I don't know what insurance you have and what the terms are. For example, if the terms don't state that the police must be called in the event of damage and your son indicates that he didn't realize that there was damage to the house, then you can ask yourself whether an obligation has been violated. My advice would be to at least check the terms and conditions carefully and contact the insurer to ask for an explanation of the process for rejecting claims in such cases. This may help you to assess whether the rejection is justified. Please feel free to contact me if you have any questions or require legal assistance.Neem de volgende stap
