Access to gyms only with a valid QR code

Questioner

Given the new corona measures as of 6-11-2021, access to the gyms is limited to a valid QR code. I am not vaccinated and I love sports, but it is not possible for me to test at least 2 hours in advance every time before exercising. In my opinion, the current situation has changed so much that I would never take out a subscription in this situation. Now I wonder what my legal rights and obligations are. I have two different subscriptions and have specified the situation per subscription. Subscription 1 This subscription is prepaid for one year. Can I legally cancel my subscription before the contract expiration date and get my money (partially) back? Subscription 2 This is a two-year subscription and expires in October 2022. Can I legally cancel my subscription before the contract expiration date and not have to pay for the remaining months? Yours sincerely,

The situation with the QR codes is different than when there was a lockdown. Back then, gyms could not provide their services because they were forced to close. Now, gyms can simply remain open, but there are different rules from the government. The gyms cannot do anything about this. This is unfortunately not a reason to cancel a subscription in principle. It can also depend on what exactly is stated in the terms and conditions regarding cancelling a subscription (since you have two subscriptions, the rules can differ). This does not affect the fact that you can always check with the gym whether they agree to an earlier cancellation. In addition, you could also ask to pause the subscriptions until the QR code arrangement is abolished again. You can contact me if you need legal support.
