Carnival association: can we refuse entry to a family?
Questioner
I am a board member of a carnival association with its own building where we organize parties. 12 years ago, there was a fight after a party night. Threats were made and the board at the time decided to permanently deny the family (who threatened) access to the building. This was done verbally and they have kept to this all this time, until now. They are demanding access to the building again to experience another party night, and are threatening to take legal action. My question is: what rights do we still have to not allow this family in?Lawyer
Since I have limited information, the answer is somewhat general. A person can challenge a refusal decision if he/she disagrees with it. A judge can then assess whether there is a good reason for the refusal and whether it is reasonable given the interests of both parties. You indicate that this concerns a threat from 12 years ago, that it is not on paper and that it concerns a permanent refusal. If you believe that the interests of the association still outweigh those of the family and that there are still reasonable grounds to refuse the family (threats/annoying behavior) you could put a new refusal decision on paper. With a 12 year old decision that is not on paper it could become difficult in a procedure. Also ask yourself (a judge will also do this) whether the situation is still such that the family could not be given another chance after 12 years. If you wish, you can contact me.Neem de volgende stap
