Am I a private person as an artist?

Questioner

I am an artist and work together with my sister in a partnership. We make controversial films with volunteer extras, this time children. Parents have given their approval, but could we theoretically be sued in the future if the parents are not happy with the result? And will our partnership be sued or will I as a private individual?

Lawyer

In theory that would be possible, but for that to have a chance of success, such a complaint must have a legal basis. As a partner of the partnership, you are personally and severally liable for the debts of the partnership. It is wise to check whether you (the partnership) are properly insured and it is also wise to check the (general) terms and conditions of the agreement you are entering into.

Lawyer

A partnership is not a legal entity. You are therefore liable as a private individual. If you have recorded everything in writing with the parents and you do not do strange things, then you run little or no risk. Insurance is therefore not necessary.
