What can I do to ensure that my AOW benefit is not reduced?
Questioner
Since 2017 I have offered a Latvian woman a (bed)room (3 by 3.5) in my house and registered her in the BRP for this purpose. She is also allowed to use the bathroom, toilet, kitchen and garden. At the time I was cut from my IOAW benefit because of this, but the SD was kindly reversed after she was unable to return from Latvia after visiting family due to Corona circumstances. (Which is still her intention). I will reach retirement age at the end of 2022 and because more or less the same rules apply to the AOW benefit, I would like advice on what I can do to avoid a reduction. I am thinking of: Postal address? Rental agreement. (Also, what is a commercially acceptable rental price for the rental of a bedroom in Borculo and shared use of kitchen, toilet, bathroom and garden. And what should and should not be filled in/checked in the standard rental agreement that can be found on the government's AOW website?) Other options? Furthermore, I would like to receive advice on what I should do if I want to cancel her registration at my home address in the BRP. Thank you in advance.Lawyer
It's good that you are already thinking about this situation. In most cases, a joint household exists if two people live together and the other person contributes to the household, for example by paying rent. You would not receive a full AOW benefit. This is different if there is a commercial relationship. Your case may possibly fall under this exception. There must be a strictly business relationship and a number of conditions must be met. You must also be able to prove that there is only a commercial relationship. I can help you to get a clear picture of the situation and give you advice.
