Placement of playground equipment directly next to house/bedroom/living room
Questioner
End of 2016 bought a house in a new residential area next to a piece of public green where two trees would be planted, according to the information we received. Our house was delivered in December 2017. In mid-2018, playground equipment was installed directly adjacent to our property boundary and directly adjacent to the bedroom window and living room window. The space between the playground equipment and the bedroom window is approximately 3 meters. Children and parents of the children can look directly into our home. There has been no consultation from the municipality. We have been trying to find a solution together with the municipality (Gooise Meren) for a year now. However, nothing concrete has happened yet, except that they are looking into it. According to the Image Quality Plan it is probably allowed (not subject to a permit, no decision so no objection possible, etc.). However, we are experiencing unlawful nuisance, because it causes a disproportionate infringement of our privacy as residents (the latter is partly a quote from an earlier case, https://steenwijkercourant.nl/steenwijk/Rechter-oordeelt-speeltoestel-Capellestraat-moet-weg-inbreuk-op-privacy-bewoonster-flat.-Dit-is-heel-vervelend.-Niet-leuk-26537978.html).Lawyer
It is not quickly a question of unlawful nuisance if children play on playground equipment such as trampolines etc. placed in gardens, which allows people to look into the other neighbour's home. However, in certain cases there can be unlawful nuisance from noise and looking in, even if the municipality is the owner of the (play) yard, the municipality should have weighed your interests, did it do so?Neem de volgende stap
