Buying a car with defects

Questioner

In July 2021 we bought a golf 7 from this company. Everything seemed fine and well until we had driven 400 km with the car. Oil consumption up to and including. Tried to reach this company by email and telephone. No answer to the email and by telephone we were fobbed off. 1600 km further we had to believe it and have a new engine installed in the car. Unfortunately I am not the only one who is a victim of these actions. Changing the engine should quickly cost you 4500€. That was also what we spent. Now without a car and 15,000 euros poorer because the car is at the garage for a new engine. What can be done about this? Now the company is responding with vague excuses and is willing to pay 25% of the price of the engine if they can get the bill in their name from the garage where the car went.

Lawyer

An engine that needs to be replaced is not covered by general terms and conditions or warranty, but is an essential feature of the car that must function well except for some minor maintenance. That is why you could cancel the purchase and claim consequential damages from the garage. Has there been a proper investigation into the technical condition of the car in advance and have you paid a market-conform price?
