Our mortgage advisor made a mistake in omitting crucial information to us that when applying for a construction fund we had to make our own contribution. So we were called by the notary 1 day before signing (end of the afternoon) 30-8-2021 with the message that there is still an outstanding invoice of 15,000 euros and 1,767.91 notary costs. And if this payment is not made before 31-08-2021 we cannot receive the keys to our home After the announcement from the notary, we contacted the mortgage advisor to find out where this huge amount came from. He first indicated that he had communicated the matter with us and did not understand what had gone wrong. We then indicated that we were only aware of 5,000 euros of our own contribution that we had already paid. Afterwards he found out that he had only discussed the extra contribution of 15,000 euros with the appraiser and had not communicated it to us. He also indicated that it was his fault. He made this known by email and via WhatsApp. He suggested that he would contact the bank/notary and the sellers. To get the construction deposit out. He indicated that the bank would possibly have the paperwork ready on Friday 3-9-2021. Which offers no certainty. He sent an email to the notary and to the sellers from whom we have not heard anything since. At this time we were living in a rental property where our rental property had to be delivered the following Monday morning (at 10:30) 6-9-2021. Considering we are a family with 2 young children aged 9 and 6, we cannot afford any risks and solutions like POSSIBLE on Friday were not an option at that time. This put us in a bind and we had to borrow money from family and pay this large amount within a few hours. We discussed this with the mortgage advisor and asked for a possible solution. At this point we had lost all our savings. We were/are in a financial crisis in which the children are also the victims. They can no longer use all the sports activities that I pay for as a father. Think of illness, unexpectedly having to go abroad, car trouble, etc. The mortgage advisor has not given a clear answer/solution to this. However, only that we can open a private loan or that we can apply for early tax refunds or that we can increase our mortgage and borrow more money. All this does not equal the 15,000 that is now stuck and it also costs us extra money to get our money back when he made the mistake and admitted it. We believe that the mortgage or his company should be held liable. Somehow we desperately need a refund or compensation. On the one hand, you are fortunate that you can still move, but there is a breach of contract on the part of the advisor for which you could hold him liable (for additional costs and consequential damage). The advisor is bound by general and specific legislation and possibly that of an umbrella organization.
