What is my notice period for my employment contract?
Questioner
In the spring of 2020, I started working for my current employer. I was given a one-year contract with a 1-month trial period. Regarding termination, the agreement stated: 'In the event of interim termination, both the employer and the employee are subject to a notice period of 2 months'. In the spring of 2021, I was given an employment contract for an indefinite period. This was recorded in an 'amendment to the employment contract', which stipulates that it is a continuation of the first agreement. With regard to termination, the 'amendment to the employment contract' states the following: 'The notice to terminate this employment contract is 2 months to the extent that the statutory notice period is not longer'. Does this meet the requirement that the notice period for the employer must be double that for the employee? Or can I still terminate with one calendar month's notice?Lawyer
The statutory notice period is 01 month. If the employer wants to deviate from this, this must be stated in the employment contract or collective labor agreement. In both cases, it must be twice as long for the employer as for you. This is not the case here. In that case, the statutory period of 01 month applies.Neem de volgende stap
