Deposit and no delivery of boat and outboard motor

Good morning, We made a down payment of 20% for a boat in March and the purchase of a second-hand outboard motor. Now we are almost 5 months further and we were promised that the boat would be almost ready and that we could make an appointment for delivery. We are kept on stringing and now suddenly one of the partners says that they have a dispute and he is going to investigate the situation with the boats and delivery. Apparently there is now an investigation into the accounts and we have to wait for that. How can we get out of the purchase and it was indicated that we would pick up the motor (but it is never the value if we sell it), how many rights do we have and do we have to file a report or have a lawyer? Hoping for an answer.

If something is wrong with the accounting, it is not within your sphere of risk, so you can simply demand delivery within x time and then cancel the agreement and claim your money back.

What is important is which (purchase) conditions you have agreed upon. When should delivery be made at the latest and is there a possibility to cancel/terminate? If no specific delivery date has been agreed upon, or if it has already passed, you should give the seller a reasonable period to still comply. You can also state that if the delivery is not made on time, you will take further steps. You should preferably send such a message by registered mail and by regular mail (or email). If the partners have a disagreement, you will not be affected. It is not the case that in that case the seller no longer has to deliver (on time). The mutual dispute is, so to speak, not your problem.
