To what extent can a breeder be held liable?
Questioner
In Dec bought 2 main coons, had an extra health check on Dec 17 because previously bought cat from other parents had health problems. Also had patella and another 1 from breeder but turned out to be really bad afterwards. I doubted then whether I should do it then. But extra health check gave me confidence. Now it turned out 3 weeks ago that 1 probably both animals have hereditary patella. 1 now has to go under the knife on Tuesday for 1 leg, the other is also weak. After a lot of hassle the breeder wants to refund the purchase price, but I actually hoped that he can also be held partly responsible for medical costs. I know that the father has been tested and was free. I don't know about the mother. They both have a pedigree, does anyone know?? What to do.. costs 1 leg around 1600 eurosLawyer
That is annoying but according to the law this is still a consumer purchase and there is a defect in the cat despite the preliminary investigation. The seller must repair the defect or if that cannot be required (because it costs too much) offer a free replacement, a healthy main coon. Being able to reclaim all medical costs that exceed the purchase price, will really not be possible. On top of that comes the doubt that you already had before the purchase.Neem de volgende stap
