What can I do against a campsite owner who has not kept to the agreement?
Questioner
Hello. My 3 brothers and I inherited our mother's caravan/bungalow last year. The campsite owner has plans to turn the campsite into a modern park. If a caravan becomes available or someone dies, there is no discussion possible. The caravan must be removed from the campsite. So selling it was no longer useful because who wants to pay the transport costs. The campsite owner came up with a proposal. We could take out the usable stuff and leave it behind after which it would be demolished together with 2 other caravans. This cost us €2450,-. Because it is also an emotional chapter in our lives, we decided to accept this offer. Close the chapter and move on with our lives. Until we noticed after about 6 months that our caravan had not been demolished, but was in use! So we went to have a look and saw that there was a code lock on it and everything was neat and tidy. The campsite owner used it to house his entertainment team. This really upset us. So the caravan was stolen from us. So we sent an email and expressed our displeasure after which the campsite owner donned sackcloth and ashes and made us a proposal to pay us €4500,-. Of course we thought this was too easy and made a counter proposal of €10000,-. I don't have the exact amounts at hand at the moment, but we still have all the email traffic. The campsite owner reacted negatively and said: You smell money, I'm not going to go along with this. I hereby withdraw my previous offer and. I also deny you access to the campsite, it is with my lawyer. This is the story in broad strokes. My question now is, what can we do with this and how strong are we?Lawyer
Apparently the owner has enriched himself at the expense of the heirs. There is a value for that plus the costs he has saved himself that you paid for demolition. I do not know what the caravan is still worth, but you should file a claim on the basis of unjust enrichment. If necessary, I can help you with this.Neem de volgende stap
