Purchase of TV in 2019

Questioner

Bought a TV for my husband who lives in a nursing home on May 22, 2019. On June 12, the screen suddenly went black. The repair cost almost €300.00. Now there is no more warranty. This is two years. I have never had a TV that broke down so quickly and just after the warranty, can this happen or can I still expect a small discount on a new TV?

The question of what you can expect in terms of durability of a new product is related to the price/quality ratio. More can be expected from a more expensive TV, but every TV has a certain period that it can be used normally without serious problems. The law states that if a defect occurs within six months, the seller, not the buyer, must prove that the defect did not exist at the time of purchase. Defects that occur after that period do not have this reverse burden of proof. That does not mean that you are not entitled to free repair or replacement. It does mean that the buyer is now burdened with the proof that the defect already existed at the time of purchase (that it is therefore product related). If the TV is broken but not due to your fault/action, you are entitled to free repair and, if that is not possible, free replacement.
