Are my rental agreements not legally valid?
Questioner
As a Belgian, I bought real estate in the Netherlands to rent out, with existing rental contracts. There are several residential units, for which house numbers such as 14A and 14B have been used in the rental contracts. However, it now appears that only house number 14 itself officially exists, but there are no separate land registry numbers for the residential units. According to the manager, the contracts are therefore not legally valid, and a tenant wants to leave for that reason. Is it true that all contracts (including the one using the existing house number 14) are now invalid? Can I recover this from the seller? Is the purchase agreement now also no longer legally valid or is that separate? Thank you very much,Lawyer
In principle, the rental contracts are legally valid. Landlords could hold you liable for breach of contract because you are renting out an independent home that is not so well known. For the tax authorities, however, this would not be a problem for the right to allowance and the rules of co-occupancy after proof that it actually concerns separate independent homes.Neem de volgende stap
