What are my rights when it comes to returning a product to an online store?

I bought an electric scooter for my 13 year old brother. Unfortunately, it is still illegal in the Netherlands. We only found out when my brother tested it outside and was stopped by the police. Now we want to return it after using it once. The webshop indicates that this is not allowed because the bike has been used. They indicate that their website states to first check the local laws before purchasing. We did not see this. “The consumer has a cooling-off period of 30 days to return the product without giving reasons, starting on the day of receipt of the product. The consumer has 14 days from the moment of return notification to return the product. After this period, the purchase can no longer be cancelled and becomes final.” It is stated on their website. However, they indicate that it is not possible to return because the bike has been used. The product has now been in for less than two weeks. What is the best thing for me to do now? Greeting

Their web shop must state prominently that you must check local laws before making a purchase. If the warning is not prominently stated and the website operates in the Netherlands, you could still terminate the agreement due to non-conformity. The cooling-off period has indeed expired and is now also not applicable.
