What can I do against an unjustified summons?
Questioner
I received an unjustified summons from a debt collection agency. It would concern products that I had ordered from China but never paid for. I paid via Klarna so that if the goods did not arrive, I would not pay money for nothing. The goods did not arrive and I had reported this to the customer service of the site where I had purchased the goods. The customer service had said that they would pass this on to Klarna and then I would not have to pay any money. Nevertheless, after some time I received a reminder for the order. I had responded to the reminder by saying that this had already been passed on to Klarna and that I would therefore not pay because the goods had never arrived. Klarna would then take care of it, they said. At a certain point Klarna kept sending reminders and I kept responding by saying that I did not have the goods and had already reported this and that I would not pay. At a certain point a debt collection agency came along that also sent reminders. I tried to explain it to the debt collection agency but they refused to cooperate or listen. Klarna had then withdrawn their hands from the case and they said that from then on I had to arrange everything with that collection agency. Tried calling several times but no answer. Last week I received a summons. It states that I have to appear in court at the end of June 2021. The papers that came with it contain screenshots of what I allegedly bought, but those screenshots do not say anything about it being cancelled by the site where I ordered it. The papers state that I have to pay, while mine says refunded. There was also a letter from the judiciary, but it was in black and white and did not look very convincing. So I thought it was strange and contacted the courthouse in question to ask if a court case was indeed planned, but they said that they could not see that yet and also said that I should call the bailiff in question who had put the papers in my mailbox. I cannot find a telephone number for the bailiff. What is the best thing for me to do at this point? And even if it were a fake summons or threat, can I report it to the police and is that wise? Thanks in advance for your response!Lawyer
A bailiff must serve you the summons, not the collection agency. Otherwise, please contact me via my website?Neem de volgende stap
