Our VvE has model regulations 1992. Year of construction 1994. The VvE has glass insurance. The damage caused by the double glazing in the sliding door from 1994 breaking in the private section in the outer wall is not covered and will not be reimbursed by the glass insurer. Article 9 paragraph 1 includes the outer walls, including the window frames with glass, in the common areas and common matters. Article 18 stipulates that glass damage in or to a private section is the responsibility of every owner and user involved. if and to the extent that no insurance exists. If and to the extent that such insurance does exist, the board shall take care of the repair. Are the costs of this damage to be borne privately or by the VvE?
