What happens to a private rental contract after the death of the landlord?

Questioner

My parents and I are privately renting a home, the owner/landlord of which will die in the short term. What rights do we have if the landlord dies? We have a self-drafted one-year rental contract, and it has now been tacitly extended once by means of a payment for a period of one year. The contract states that there is a notice period of 3 months, with mutual consent. What can we expect from the legal certainty after the death of the owner?

Lawyer

A contract has been created with an indefinite term by extension and if the landlord dies you simply continue that contract. The heirs may be able to provide a good reason for termination but that is done via a request to the subdistrict court.
