What if my neighbours plant a lime tree against my wall without asking?
Questioner
My storage room has been extended, so on the neighbours' side there is a piece of solid wall. My water drain pipe runs along the wall. The wall is not made of stone but a plastered one is quite soft. They have pushed the accompanying bamboo sticks behind the water pipe. In my opinion an unlawful act. The APV states that trees must be planted at least 50 cm from the property line, which is already little. This is not a fence between two gardens, this is a different situation. The 'wall' lacks sun and wind, which means it stays wet for a long time and algae formation can occur and may also have an effect on the inner wall. The roots can damage the foundation. Attempts to reach an agreement were unsuccessful. I'm really annoyed that I would have to go to court for this. Is there another option? Shouldn't the municipality be involved in this?Lawyer
The municipality cannot do anything with this because this is not an administrative but a civil matter. If you cannot reach an agreement with your neighbour, there is the possibility of a lawsuit (civil court). It may help if your neighbour is written to by a lawyer if you cannot reach an agreement.Questioner
Thank you for your response. Understand that I cannot avoid hiring a lawyer. Your profile does not state that you handle civil lawsuits, do you have sufficient knowledge of this, you did respond to my call, so I assume that you may want/be able to handle this case? Perhaps a letter from a lawyer would indeed be sufficient, I hope so. It seems to me that the neighbors are acting unlawfully. What could the costs be? I look forward to hearing from you.
