What happens if I become ill for some reason during the fictitious WW notice period?

Questioner

I am considering signing a settlement agreement for dismissal with a 4 months fictitious notice period. I have worked for 30 years and am not sick when signing the agreement. Suppose I become ill during the fictitious notice period (accident or otherwise). Am I entitled to unemployment benefits? Or another benefit?

Lawyer

If you are sick and leave employment, you are in principle entitled to a ZW benefit instead of an WW benefit. Signing during illness is risky in relation to the possible benefit. I advise you to seek advice before you sign the settlement agreement that may be offered (certainly considering the length of employment).

Lawyer

If you are not sick now, you can sign. If you become sick during the remaining time, this will not have any consequences for your benefit. It is wise to have the VSO checked by a specialized labor law attorney (member of a specialized association), such as me. The first meeting is often free, such as at my office. Many employers also reimburse the costs associated with the check.
