What should I answer if the VVE wants to change the internal regulations to my disadvantage?

Questioner

I just bought an apartment in Amsterdam and plan to live there with two friends. I have already applied for and paid for a rental permit for the third resident. The VVE consists of 3 households each with 1/3 claim. The VVE wants to adjust the house rules so that you cannot rent out without permission from the entire VVE. This is very inconvenient for me because 1. I want to rent out now and 2. I may want to rent out the entire apartment later if I ever move abroad. I also find the other points in the house rules rather strict. My question is actually how I can best answer this?

Lawyer

The members' meeting of the VvE has the say; there is joint ownership. The meeting can therefore take valid decisions by majority. There are rules for the legally valid taking of decisions in a VvE meeting. A VvE decision may not conflict with the articles of association and deed of division; if this does happen, the decision is null and void. If you believe that a decision has been taken that disproportionately burdens you, you can request the court to annul that decision within one month after the decision was taken. It is important that you keep a close eye on that period, because after that the VvE decision can no longer be challenged. It is a difficult matter. If you wish, I can assist you with this.
