Retail property: Can I renovate an existing part without a permit?
Questioner
We inherited a shop and now the rear part which is storage is very outdated. I have requested drawings but I think that it was built illegally without a permit. It has been standing for about 40 years now I think... on both sides of the building everything has been built up, either with a permit but I think also a lot illegally.... At the rear of the building against the property line there is a large shed of a steel construction company. If it has been standing for more than 40 years is it still illegal? I want to renew it because of leakage and vermin, but I'm afraid that if I break it down and rebuild it neatly, that won't be allowed.... What do you think?Lawyer
Yes, then it is still illegal and enforcement can be imposed. But it is possible that the various extensions next to each other that are not enforced and do date from the same period, make an appeal to the principle of equality and legal certainty possible.Lawyer
It is possible that the constructions in question are no longer subject to a permit due to the expansion of the legal possibilities. This would mean that they can be rebuilt without a permit. To ensure this, this will have to be assessed by an expert. You will not be able to suffice with a permit check on www.omgevingsloket.nl, since this check does not include local regulations. Building in conflict with the zoning plan requires a permit, but the environmental desk does not assess this aspect. Given the age of the buildings, which date from before 1994, an asbestos inventory report must be drawn up before demolition takes place.Neem de volgende stap
