What steps do I need to take to regain some of my parental authority?
Questioner
Due to a change in the Youth Act, I signed a terminated measure a number of years ago. I would like to know what my options are and what I need to do to regain my authority or partial authority.Lawyer
Ir/Madam, The court may, on the basis of Article 1:277 of the Dutch Civil Code, restore parental authority to the parent whose authority has been terminated at his request if: a. restoration of authority is in the best interests of the minor, and b. the parent is able to bear the permanent responsibility for the care and upbringing of the minor referred to in Article 247, paragraph 2. If authority has been assigned to the other parent, the court will not charge the parent whose authority was terminated (you) with authority, unless the circumstances have changed after the order was made in which authority was assigned to the other parent, or the order was made on the basis of incorrect or incomplete information. This is not a simple procedure where there really has to be a change after the decision was made by the judge. If you would like to discuss this, you can contact me directly.Neem de volgende stap
