What does the law say about removing ivy?

Questioner

With the neighbours behind us, we have an open wooden fence that was already there when we moved in. Ivy grows against the fence, which probably also grows on their side of the fence. We now want to remove the ivy completely. Do we have to take the neighbours' wishes into account? Is there anything in the law about this? On the internet I mainly see things about when you are bothered by the vegetation in your neighbour's garden. I'd like to hear from you.

Lawyer

Both neighbours must ensure that their own ivy growth does not cause any nuisance to the other. This means that their own ivy must be pruned regularly, consultation is not necessary. If the ivy belongs to both of you, you must consult with the other neighbour before removing it. If you cannot (yet) reach an agreement and a legal dispute arises, we can assist you in this matter. If desired, please contact me for consultation.

Questioner

Thank you for the quick reply. The ivy is planted in our garden, that is why I asked this question and that is why I would like to know if we owe anything to the neighbours. I'd like to hear from you. Greetings, Anja Oomen
