What can I do about poorly completed work on my home?

Questioner

In November 2019, my roof was fitted with new roof tiles and special roof foil that prevents leaks. In November 2020, a dormer was installed and the roof foil was not replaced correctly by the company. As a result, I now have a leak at the top and there is a chance of leaks all around. This was determined by the roofer, who indicated that the only good solution is to re-cover the entire roof surface with foil. The company does not want to take responsibility for solving this free of charge and indicates that simply reattaching the foil at the top would also be sufficient. If they were to do this, they would charge €250 for this. The leak was caused by the placement of the dormer window so the solution should not disadvantage me in any way. Only repairing the top would not be sufficient and certainly not for a fee.

Lawyer

The company must replace the roof foil in the same way. You have damage (leakage) as a result and you can therefore hold the company liable for this damage. It must then be clear that the company caused this damage. In short, the damage must be attributable to the company. If you have photos or other evidence, you can submit this with the claim. If you cannot (yet) reach an agreement together and a legal dispute arises, we can assist you in this case. If you wish, please contact me for consultation.
