What can I expect from my employer? I would like to hold them partly liable.
Questioner
I called work to say I didn't think it was responsible to go on the road. Yet I had to come to work even though code red had been issued. I slid off the road into the crash barrier, causing the following injuries: broken headlights, broken grill and front bumper, paint damage to the hood, broken driver's side door.Lawyer
The starting point is that damage sustained during commuting does not fall within the employer's sphere of risk. Sometimes there are exceptions, namely if the employer was aware of a particular danger and could take measures to prevent damage. Given your case, such an exception may very well apply. In any legal proceedings, it will then depend on the extent to which you can prove that the employer was aware, warned you of the danger and that the employer (still) summoned you to come to work. Incidentally, I assume that your damage is not covered by your insurance.Neem de volgende stap
