We have a new contract, has the old contract expired?

Questioner

Good afternoon, Last September we were going to get married in Spain. We have already paid 60% for this. There is a cancellation clause in the contract that if we cancel more than 100 days in advance, we do not have to pay the remaining 40%. The contract is Dutch because the owners of the accommodation are also Dutch. Due to corona the wedding in 2020 could not take place and we moved the wedding (>100 days in advance) to April 2021. However, we only received the new contract with the adjusted date to sign today. We still have to do this. We are now 90 days before the wedding in April 2021. We have serious doubts whether April will work out this year. After all, Corona is still in full swing. What does this mean? Has the old contract with the old date 'expired' and if we decide not to get married in April 2021, do we have to pay the remaining 40%?
