When are you liable for damage?

Questioner

Dear lawyers, So I recently went to a party that I was invited to. The people who organized the party had rented out a room. At one point I leaned on the sink in the toilet (I was leaning against it a bit) and it broke off. My question is: who is responsible for this damage? Thank you in advance!

Lawyer

You in principle, but you could defend yourself by stating that the sink was not properly or securely attached.

Lawyer

In principle, everyone bears their own damage, unless someone else is liable. In this case, the hall was rented by a party that was not you. The tenant of the hall will probably be approached first. It will depend on the conditions of the rental of the hall and how the delivery etc. took place. You can probably imagine that after a party considerable damage will be attributed to the tenant. It will have to be demonstrated that the hall was in considerably better condition before the rental. The owner of the venue will have to demonstrate that there is a shortcoming in the performance. If you are directly addressed, this will be difficult, who says that you caused the damage? Who else leaned on the sink? Wasn't the sink defective in the first place. Can't you just state that the sink was a danger to you and the others?
