Liability when purchasing a house: what now?
Questioner
Good evening, We bought a house in November. We were very happy with it. During the sale, we were told by the real estate agent and saw it ourselves that three windows were leaking and they were dull. We did not find this a problem and there was nothing to see in the rest. The purchase contract also stated that several windows were leaking. No numbers were given or where they were located. While this was requested. But we took into account that there were three and thought we would fix it when the weather improved. But now that the weather is getting better, it turns out that there are not three leaking. But of the 25 windows, 21 are leaking. That is 18 more. I thought this cannot be right. Upon further information from the neighbors, it appears that there was a production error from the year 1997. The house is from 1998. All residents received a letter for this (unfortunately they no longer have this) and in case of leakage they would replace it. According to the neighbours, the seller of our house was aware of this and did nothing about it. He was abroad more often and was hardly ever there. But he did not mention it during the sale. And there is also nothing mentioned in the sales contract. Yes, several, that's a few. but not all. I spoke to the seller about this and got an answer. (yes, I knew that. It never bothered me and it also says that several windows are leaking. I reported it and will not do anything about it. Just go to the estate agent). He fobbed me off. Instead of a few hundred euros that we had expected. it now costs us a few thousand euros What can I do with this? Help, I don't know what to do anymoreLawyer
Hold the seller liable for fraud/error and non-conformity of the purchased item. This should be constructed properly, but what you already have is a statement that the seller was aware of the defect; he should have fully informed you before the purchase. I can help you draft a good letter in which this liability is established.Neem de volgende stap
