Legal rights in case of contract problems
Questioner
Hello, I had a contract with youfone for tv at home and internet. When I received the installation package, and then I read everything carefully, it turned out that tv is delivered via internet. But my order clearly states tv at home, and internet. Since I do not want to receive tv via internet, I called immediately and they could not deliver otherwise, I then immediately canceled, and cancelled the contract, the man on the phone would arrange it. Still I got the bills, yes I was apparently outside the 14 day inspection period, but that is also because you only get the installation package shortly before the contract starts, so just before the delivery takes place. Earlier I could not see that I did not get what I asked for. Now I have indicated several times that I do not want this, and also indicated that they cannot deliver what I ordered, namely tv at home, and internet, but now I only have internet, and I have to watch tv via internet. I think that this contract is also legally invalid, since I get something different than I ordered. Unfortunately they don't want to know anything about canceling and keep sending reminders that I have to pay, but even that amount is wrong. I would have a 6 month discount, and the contract would start halfway through the month. Now they say that the discount is only given on the whole month, and that half a month is the full amount. There is nothing about that in the confirmation of my order either, they keep ignoring what I indicate. Am I right about this, and is this contract not legally valid, and can this just happen?Lawyer
You can cancel the purchase and the service, the date on which the cooling-off period starts after you have received the goods if they come into your possession. If that is not the case, you can also argue that the service provider has not been transparent about the main characteristics of the service, as a result of which you as a consumer are not yet bound to the agreement, (6:230 ma) finally, this can also result in an appeal to error (you thought internet and TV, not TV via the internet) and that with these new facts you had not concluded the agreement and therefore annulled it (6:228 paragraph 1)Neem de volgende stap
