Questioner

Ir/Madam, I have been working for my employer since May 2018. For my work I receive 161 euros per month according to my pay slip, stating Home - Work traffic. This is also stated on my pay slip. In addition, my current employer pays my OV business card every month. The costs are not stated on the pay slip. Now my employer is asking me if I want to pay back those 161 euros per month or have them offset against my salary yet to be received. Because according to them I will receive double travel expenses compensation. My current contract expires on 1-2-2019. Can this be done by my employer? Thank you in advance for your answer and response,

Whether this is allowed depends on the agreements made. If there is a collective labor agreement or personnel handbook, these can provide clarity. From your explanation, I gather that the employer pays double, but this depends on the agreements made regarding the business card.

I have a collective labor agreement for housing and corporations. I understand from this that either a public transport business card may be given or via a home - work traffic scheme. The only thing is that they never informed me in those 8 months that I make double costs by means of the home - work scheme (which is stated on my pay slip.) and the costs of my public transport business card are not stated on my pay slip. I always thought that those home - work costs were precisely the costs of my public transport business card. If it is right I want to pay it back properly. But I want to be sure that it is allowed to inform me about this after 8 months. In my opinion this is an administrative error on their part. Thank you in advance for your response,

It is sloppy of the company to report this after 8 months, but if there is an administrative error, you will unfortunately have to pay back. You can make a payment arrangement if necessary. If you have had to make double costs, this must be paid back by the employer.
