Question about bankruptcy of construction company? Get free advice

Questioner

I bought a new-build apartment, I signed the purchase/purchase agreement with the construction company, now the company has gone bankrupt and they are looking hard for a new construction company. The construction has been at a standstill for 2 months. I have not yet been to the notary but have already arranged my mortgage. Now my question is whether the purchase/purchase agreement is still legally valid, since the company no longer exists. Can I still cancel the purchase of the apartment? Or should I wait until a new contractor is in place, do I have no choice and can I only wait?

Lawyer

Unless the receiver has indicated very quickly that the completion is guaranteed in accordance with the agreements, I assume that the agreement can be successfully terminated. You do need to take action, the agreement does not automatically cease to be valid. And if you do not object, it will be more difficult for you to object to the increasing delays later. I advise you to engage a lawyer who will then have to review the purchase agreement and correspondence from the trustee and then terminate the agreement (unless any surprises emerge from his/her homework). I would probably actively push to get out of the contract and have my hands free again. YOU
