Liability for parking damage | Legal aid

Questioner

I wanted to park this morning at the public parking lot of Burger King. Only they had hung an iron chain on the passage at a height of less than 1 meter. Because it was still quite dark outside I didn't see the chain and hit it quite hard. Can I claim this damage from them?

Lawyer

I wonder if this place is always open to the public or only during the chain's opening hours?

Lawyer

Often the parking space is partly rented or another arrangement has been made with the owner of the parking space, so that it can be classified as public but in fact falls under the management of the burgerking. If this is the case, then the burgerking must ensure that this place is accessible without obstacles so that safety is not compromised. I do not know why the iron chain was there if it is a public place. From your explanation it seems that the burgerking has not been careful with regard to safety and you can therefore in principle hold them liable for your damage. More may be known in the general terms and conditions. If you would like to discuss the matter, you can contact me or one of the lawyers directly.
