Liability after a collision - Legal Advice Centre
Questioner
Situation: I am dropped off as a passenger in front of my house, narrow one-way street with cars parked on the right. There was a narrow strip between the right-hand door I had to open and the parked cars, through which a cyclist coming from behind wanted to cycle. When opening the door, the cyclist came into contact with the door, fell and took the left wing mirror of a parked car with her in her fall. Fortunately, the cyclist was not injured, but my neighbour's mirror broke off. I assume that I am responsible for the situation that arose and the associated damage. Can I claim my AVP in this case?Lawyer
You will indeed be held liable for the damage, because you should have taken the necessary precautions when opening a door. Furthermore, it depends on the road situation whether the cyclist was allowed to cycle there. You must report the damage to your insurer. You cannot rely on your AVP.
