Maternity leave and temporary contracts | Legal aid centre

Questioner

Hello, I work for an organization and have a temporary contract until July 31, 2019. Now I have become pregnant and have maternity leave until September 1, 2019. It is still the question whether my contract will be extended. Does the organization have to pay my maternity leave until the end, or are they only obliged to do so until the end date of my current contract? (so July 31)

Lawyer

If your temporary contract expires on 31-7-2019, you will receive the remaining maternity leave benefits directly from the UWV, instead of your employer. Your employer does not have to pay your entire maternity leave. There is a possibility to receive the benefit directly from the UWV from the start of your leave. Your employer must then report this to the UWV. Your employer may not refuse to renew your contract because you are pregnant.
