Claiming sickness benefits from your employer | Legal Aid Centre

Questioner

Dear, I reported sick to my employer on July 24, 2018. I have not heard from my employee during the entire period of illness. The contact always came from my side. Now I reported myself better last Friday. In the period from July to August I have not received any sick pay, despite having requested it several times. How can I claim my sick pay from my employer? Can I also claim more sick pay because I have not received wages for several months?

Lawyer

You are entitled to continued payment of wages. According to the law at least 70%. In many collective labor agreements the FNV has arranged a higher percentage. Sometimes an individual employment contract also states a higher percentage. You must send the employer an email or letter (keep a copy) in which you claim continued payment of wages. You can claim the statutory increase of 505 (article 7:625 Civil Code) and the statutory interest (2% per year). If the employer still does not pay, go to a specialized labor law attorney as soon as possible.
